1. Who we are 
Ace Fitness & Reformer is operated by Ace Padel 1 Ltd, a company registered in England and Wales.

In these terms, “we”, “us” and “our” mean Ace Padel 1 Ltd trading as Ace Fitness & Reformer. “You” means the member named on the membership. 
Ace Fitness & Reformer operates from The Daten, Charnock Rd, Culcheth, Warrington, WA3 5SH. 


2. Membership 
2.1 Membership types 
We offer the following membership options at the time of writing:

- Open Gym membership - access to the gym floor and equipment during opening hours. 
- Classes & Open Gym membership - access to the gym floor plus our group class timetable. 
- FOUNDER membership - a limited membership with a price frozen for the lifetime of that membership, available whilst founder places remain. 
- Reformer/Mat Pilates - run separately on a class pack basis rather than as a rolling membership.

2.2 Eligibility and age restrictions 
There is no minimum age to take part in Gym Classes provided the participant is accompanied at all times by an adult (aged 18 or over) who takes responsibility for their supervision.

Unsupervised use of the gym, including Open Gym sessions without an accompanying adult, is restricted to members aged 16 and over.

The minimum age for Reformer/Mat Pilates is 16 years of age.

We reserve the right to ask for proof of age and to refuse or restrict access where this policy is not being followed.

2.3 Health and PAR-Q 
Before your first session, you'll be asked to complete a Physical Activity Readiness Questionnaire (PAR-Q). This helps us understand whether there's anything we need to be aware of to keep you safe, and whether we need medical clearance from you before you take part in classes, Open Gym, or reformer/mat Pilates. 
You must tell us about any change to your health that may affect your ability to exercise safely, even after your PAR-Q has been completed. Where a PAR-Q flags a risk, we may ask you to provide medical clearance before you take part or may restrict certain activities until you do.

3. Payment 
Membership fees are collected via Clubright, our gym management platform, using its integrated payment processing. 

Direct debit and card are both available for recurring membership payments. 

Membership fees are payable in advance, on the collection date set out at sign-up, for as long as your membership continues. 

If a payment fails, we'll attempt to collect it again and may contact you to update your payment details. We reserve the right to suspend access to the gym and classes if payment remains outstanding, without affecting your obligation to pay any amount owed. 

FOUNDER membership pricing is frozen for the lifetime of that individual membership, on the condition the membership remains continuous and in good standing. If a FOUNDER membership is cancelled and later rejoined, it will be treated as a new membership at the current rate, and the founder rate cannot be reinstated. 

4. Cancelling your membership 
You may cancel your membership at any time by giving us 30 days' written notice (email is fine). Your membership, and any associated payments, will continue for the remainder of that 30-day notice period.

You can cancel your membership at any time by giving at least 30 days' written notice. Your cancellation will take effect at the end of the notice period regardless of reason given.

When cancelling, we'll ask you to select a reason and, if you'd like, add a comment:

  • Medical injury
  • Health issues (chronic illness)
  • Relocation
  • Lack of use
  • Facility dissatisfaction

This is so we can understand and improve the experience — it does not affect your right to cancel or the timing of it, and no evidence is required.

A request can be made via your Clubright account.

4.1 Freezing your membership 
Membership freezes are considered on an individual basis. A freeze request can be made via your Clubright account – once it has been submitted, we'll review it and confirm the terms with you directly.

You can freeze your membership for a minimum of 1 month and a maximum of 3 consecutive months within any 12-month period for one of the following reasons:

  • Medical injury
  • Extended travel
  • Financial hardship
  • Pregnancy or birth
  • Health issues (chronic illness)

Freeze requests must be submitted at least 30 days before your next payment date to stop the upcoming payment, and are subject to review.

There's no fee to freeze your membership.

5. Class, Open Gym, and Reformer Pilates bookings 

Classes, Open Gym, and Reformer/Mat Pilates sessions are booked through Clubright. Spaces are limited and allocated on a first-come, first-served basis.

5.1 Booking and cancelling 
You can book onto a Class, Open Gym, or Reformer/Mat Pilates slot up until 30 minutes before it starts, subject to availability.

You can cancel a booking up until 60 minutes before the Class, Open Gym, or Reformer/Mat Pilates session starts, without penalty.

5.2 Late cancellations and no-shows 
Cancelling within 60 minutes of a Class or Open Gym slot, or not showing up at all, will be recorded on your account as a late cancellation or no-show.

Three late cancellations or no-shows will result in your membership being placed under review. We'll contact you before any further action is taken.

For Reformer/Mat Pilates specifically, a late cancellation or no-show will also result in one class credit from your pack being used, in addition to being recorded on your account.

6. Conduct and use of the facility 
Ace Fitness & Reformer sits within The Daten, a shared site that also hosts Ace Padel Culcheth, dance, tennis, football, a community café, bar, and the Ukrainian Family Hub. We ask all members to be considerate of other site users and to follow any reasonable instructions from staff or coaches regarding safe and appropriate use of equipment and facilities.

We reserve the right to suspend or terminate membership, without refund, in cases of conduct that puts the safety of others at risk, damages equipment or the facility, or is abusive or threatening towards staff, coaches, or other members or visitors to The Daten.

6.1 CCTV 
CCTV operates on site for the safety and security of members, staff, and visitors. See our Privacy Policy for details of how this footage is used and retained.

7. Assumption of risk and liability 
Exercise carries an inherent risk of injury. You take part in classes, Open Gym, and Reformer/Mat Pilates at your own risk, and are responsible for exercising within your own ability and following coach guidance.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under English law. 

8. Changes to these terms 
We may update these terms from time to time - for example, to reflect changes to our membership structure, class offering, or the platforms we use. Where we make a material change, we'll give members reasonable notice before it takes effect.

9. Governing law 
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
